NOTICE (Update 10/19/2022):  THE PARTIES HAVE REACHED AN AGREEMENT RESOLVING ATTORNEYS’ FEES, COSTS, AND EXPENSES FROM DEFENDANTS IN THE NIO CASE AND SEEK COURT APPROVAL OF THE SAME

On October 18, 2022, the parties submitted a Joint Motion for Approval of Settlement Regarding Plaintiffs’ Claims for Equal Access to Justice Act Attorneys’ Fees and Costs (Nio Dkt. 337) to the Court, attaching the Settlement Agreement (Nio Dkt. 337-1) that resolves the attorneys’ fees and costs issue.  Nio class members may communicate with counsel regarding the attorneys’ fees settlement, including any objections that class members have to the settlement, by emailing class counsel at [email protected] and entitling the email (in the Subject line) “Nio Attorneys’ Fees Settlement Comment.”  All comments should be sent to class counsel on or before November 3, 2022, and class counsel will file a notice with the Court summarizing and attaching any responses from class members to the proposed attorneys’ fees settlement agreement on November 4, 2022.
